This General Service Agreement (“Agreement”) governs DigiSoft Bt.’s (“Provider”) hosting, domain, and server hosting services. By signing an order form, the Customer expressly accepts these terms. General use of the website is governed by our Terms of Service; this document applies specifically to ordered hosting, domain, and hosting services.
The Provider supplies the Customer with the service specified on the domain registration order form and the hosting service order form, for which the Customer pays the fee set out in the Provider’s price list. The Customer can access the service only via the username(s) and password(s) issued by the Provider.
The Provider must supply the ordered service as described in Section 1, and provide free customer-service advice related to the service. This does not include training, strategic planning, installation, repair or maintenance of the Customer’s hardware or software, troubleshooting arising from misuse, or making the Customer’s equipment fit to receive the service - the Provider may charge separately for these if requested.
The Provider may only process the Customer’s data in accordance with applicable data protection law (see our Privacy Policy).
The Customer must pay invoiced fees when due, and must notify the Provider in writing of any change to their details.
The Customer must use the service for lawful purposes only. It is prohibited to use the service in connection with data protected under applicable Hungarian or international law as a business or personal secret or by copyright, or in connection with a criminal offense, or in any way suited to such use. The Provider excludes liability toward third parties in this respect, given that it has no means of controlling the content of data traffic.
The Customer acknowledges that use of the service is entirely at their own risk. The Provider guarantees the services described in Section 1 on the basis of 99% annual uptime, and excludes liability for consequential damages except where its liability is proven beyond doubt.
The following are prohibited on hosted storage space:
The Customer pays the monthly or annual fee set out in the Provider’s price list, based on the Provider’s invoice - see Price List and Hosting Packages. The Provider may increase fees unilaterally without separate notice, provided the increase does not exceed 20% of the prior fee, or the change is published on the website. Fees are due as stated on the invoice. Late payment accrues daily interest at twice the prevailing central bank base rate annually. Service is suspended after 15 days of non-payment.
The parties enter into this Agreement for an indefinite term. Either party may terminate it without cause by registered letter sent by post, effective the last day of the month, with one month’s notice. If a paid-for service is terminated, the Provider continues supplying it until the paid-through date, without obligation to refund.
The Provider may terminate the Agreement with immediate effect if the Customer fails to meet a payment obligation despite a first written demand, or if it detects any indication of the prohibited conduct listed in Section 2. Termination does not release either party from obligations (e.g. payment) that arose before the termination date.
Matters not covered by this Agreement are governed by the applicable Hungarian Civil Code and other relevant legislation, as well as applicable Hungarian internet standards. Any dispute arising from or in connection with this Agreement is primarily subject to the ordinary courts, unless the parties later agree to an arbitration clause.
